PLANS AND CREDITS. Artificial intelligence features consume credits. Each person receives a free trial of 500 credits, once only; once it is used up, those features and the Search Engine require a subscription to a paid plan (Pro, Max or Ultra), which renews automatically every month until the User cancels it (§ 4). The rest of the Platform remains available without a plan. This is a product in continuous evolution: its features, content and availability may change. These Terms must be read together with the Privacy Policy, which forms an integral part of the contractual framework between the User and ERa.
1. Identification of the Parties and Acceptance
These Terms and Conditions of Use (hereinafter, "the Terms") constitute a legally binding agreement between Artifizio Technology LLC, a Limited Liability Company organized on August 17, 2026 under the laws of the State of Wyoming, United States of America, registered with the Wyoming Secretary of State under registration number 2026-002058211, with its address at 30 N Gould St, Ste R, Sheridan, WY 82801, United States of America, which operates the Platform under the trade name "ERa analytics" (hereinafter, "ERa", "we" or "the Platform"), and the natural or legal person using the Platform (hereinafter, "the User" or "you").
Acceptance of these Terms is given expressly by ticking the acceptance box provided on the Platform or, failing that, tacitly through continued use of the services. Whoever accepts declares that they have sufficient legal capacity to be bound and, when acting on behalf of a legal person, that they hold sufficient authority to bind it.
The User acknowledges that the Platform is designed for the professional practice of law in Venezuela and for legal research. The Platform does not verify the lawyer status of whoever registers —the Inpreabogado number the User declares is self-reported data, not checked against the INPREABOGADO register— nor does it make access to its features conditional on proof of that status. It is the User's sole responsibility to ensure that their use of the Platform meets the substantive conditions the law requires for each action; notably, that standing to demand payment of professional fees for court work is governed by Art. 22 of the Lawyers Act (Ley de Abogados) and is decided by the court, not by the Platform. If you do not accept these Terms, you must refrain from using the Platform.
2. Definitions
- Platform: the ERa analytics application, owned by Artifizio Technology LLC, accessible at
https://era-analytics.appand its subdomains, including its applications for Android and iOS mobile devices, as well as ancillary services. Any change in the Platform's trade name does not alter the identity of its owner, the ownership of accounts already created, or the rights and obligations arising under a previous name. - User: the natural or legal person who creates an account and uses the Platform, typically a practising legal professional, without the Platform verifying or requiring that status as set out in § 1.
- Client User: the person who accesses the Client Portal with a client-type account, created at a User's invitation, whose access is limited to the information on the cases that User shares with them. Unless expressly stated otherwise, the obligations these Terms impose on the User also apply to the Client User insofar as relevant.
- Account: the set of credentials and settings that allow the User to access the Platform.
- User Content: any data, file, document, text, image or information that the User uploads, enters, generates or transmits through the Platform, including cases, digitized case files, client data and professional proposals.
- User's Client: the natural or legal person represented by the User in their professional practice, whose data may be processed through the Platform on the User's instructions.
- Team: the collaborative group of Users made up of a director and collaborators with granular permissions.
- Client portfolio: the module for managing the User's corporate and individual clients.
- Firm Administration: the module in which the User records their firm's income, collections, reimbursable expenses and operating expenses, and from which the Platform derives profitability indicators.
- Client Portal: the section of the Platform, with its own routes and permissions, through which Client Users check the status of the cases their lawyer shares with them.
- Procedural milestone: each act, time limit or deadline generated by the Platform's calculation engine for a given case.
- AI Services: the Platform features that use third-party artificial intelligence models for optical character recognition, segmentation or analysis of case files, for generating summaries and for answering natural-language questions about the Corpus.
- Privacy Policy: the separate document governing the processing of personal data collected through the Platform, available at /privacy.
- Official Sources: the organs of Public Power that issue or publish the information the Platform displays, in particular the Supreme Tribunal of Justice and the judicial circuits of the Republic, the National Assembly and the Autonomous Service of the National Printing Office and Official Gazette (Servicio Autónomo Imprenta Nacional y Gaceta Oficial).
- Public Source Information: the court decisions, normative acts, issues of the Official Gazette and other documents issued by the Official Sources, which are publicly accessible and may be consulted directly by anyone on those bodies' portals. They do not constitute User Content and are not owned by ERa.
- Corpus: the body of Public Source Information collected, indexed and structured by ERa for display through the Platform's search engine, together with the indexes, classifications and analytical results derived from that processing.
3. Purpose of the Agreement
ERa makes available to the User a technology tool supporting the professional practice of law and legal research in Venezuela, organized in two blocks: law firm management and consultation of the Corpus of public sources. Its main features include:
- Recording of court cases, identifying the parties, the court and the applicable proceeding.
- Automated calculation of procedural milestones in accordance with the time limits set by Venezuelan procedural law, taking into account court business days (días de despacho), court holidays and national public holidays.
- Procedural modelling with branches (decision points) for the supported proceedings, including preliminary objections (Art. 346 of the Code of Civil Procedure, CPC), mandatory notification of decisions issued out of time (Art. 251 CPC) and the other situations provided for in each proceeding.
- Management of typified and free-form procedural incidents.
- Deadline calendar and collaborative record of court business days per court.
- Client portfolio with corporate data, documents and proposals for professional services.
- Processing of case files through OCR and artificial intelligence.
- Collaborative Teams with granular permissions.
- Firm Administration: recording of income, collections, reimbursable expenses and operating expenses, with profitability indicators and merely indicative currency equivalents (§ 15 bis).
- Client Portal: read access, for the client invited by the User, to the status of the cases the User shares with them (§ 15 ter).
- Search engine over the Corpus of Public Source Information —decisions of the Supreme Tribunal of Justice and of the judicial circuits, the Official Gazette and the legal system— with structured results, derived indicators and answers to natural-language questions, on the terms and within the limits of § 9 bis.
- Notifications to the User by email and, on the mobile applications, through push notifications; and, optionally, email communications to the User's clients.
The Platform DOES NOT constitute or replace the professional practice of law or specialized legal advice; it operates as a support tool for the duly authorized professional.
4. Plans, Credits, Product Evolution and Service Availability
4.1. Credits. Artificial intelligence features —the Search Engine assistant and its conversations, case analysis and summaries, recognition and analysis of case files, and data extraction and drafting in "My documents"— consume credits. Each operation deducts the credits corresponding to its actual computing cost, which depends mainly on the length of the material processed; the Platform shows the available balance at all times. An operation that started with a balance is completed even if it exceeds it, and the excess is deducted from the same period. Credits are not money, are non-refundable, cannot be transferred to another account and do not carry over from one period to the next.
4.2. Free trial. Each person receives a single trial of five hundred (500) credits, with no expiry date and no renewal. The trial is tied to the User's email address: deleting the account and registering again with the same email address, or with a trivial variant of it, does not restore it, and what has already been consumed is kept. Once the trial is used up without a current plan, the artificial intelligence features and the Search Engine over the Corpus (§ 9 bis) are suspended; the rest of the Platform —cases, computation of time limits, calendar, firm administration, Client Portal— remains available.
4.3. Plans. ERa offers monthly subscriptions to the Pro (1,000 credits per period), Max (2,500) and Ultra (6,250) plans. The current price, in the User's currency, is the one shown by the app store or by the website's payment page at the time of purchase. The plan's credits are replenished at the start of each billing period.
4.4. Purchase, payment and automatic renewal. Subscriptions are purchased within the application and charged by the store (Apple App Store or Google Play) to the User's account upon confirmation of the purchase, or on the website, where they are charged by Stripe, through its Link service, on its own payment page; ERa neither receives nor stores the User's payment details. The subscription renews automatically at the end of each period, for the same term and at the current price, unless the User cancels it at least twenty-four (24) hours before the end of the current period. The User manages and cancels the subscription from the account settings in the store or, if it was purchased on the website, from "Manage my subscription" in the plans section of the account; upon cancellation, the User keeps the plan until the end of the period already paid. The User may not hold two paid subscriptions at the same time, nor purchase another while the existing one has a pending charge.
4.5. Plan changes. When moving to a higher plan, the new plan and its credits apply immediately and the store or Stripe, depending on where it was purchased, applies its own proration; when moving to a lower plan, the change applies from the next renewal.
4.6. Refunds. Refunds for subscriptions purchased in the application are decided and processed by the store that charged them, in accordance with its policies. Refunds for subscriptions purchased on the website may be requested at soporte@era-analytics.app, and ERa decides them case by case; Stripe, through Link, may also grant them on its own in the cases provided for in its terms and by law. A refund granted terminates the corresponding plan.
4.7. Price and credit changes. ERa may change prices, the credits of each plan or the range of plans, giving reasonable advance notice to the registered email address or through a notice on the Platform. A change does not affect the period already paid; the store will obtain the User's agreement where its rules so require.
4.8. Evolution and availability. The Platform evolves continuously. Accordingly:
- The computation of time limits depends on data that changes —the court business days each court publishes, procedural reforms, decreed holidays—, so the Platform may contain errors or omissions. The User assumes the enhanced duty of verification imposed by §§ 9, 9 bis and 10.
- ERa does not guarantee uninterrupted availability of the service. Scheduled downtime may occur for maintenance, updates or the resolution of technical incidents.
- ERa may modify, suspend or discontinue the Platform or any of its features, in whole or in part, at any time, without this giving rise to any obligation to compensate the User.
Where a change is substantial and affects the User's ordinary operations, ERa will endeavour to give reasonable advance notice through the registered email address or through a notice on the Platform itself.
5. User Account and Security
To use the Platform, the User must create an account by providing truthful, accurate and up-to-date information (name, email address and password), or sign in through an authorized federated identity provider (for example, Google).
The User is responsible for:
- Keeping their access credentials confidential, choosing strong passwords and refraining from sharing them with third parties.
- Keeping the account information up to date and verifying their email address when the Platform requests it.
- Notifying ERa immediately of any unauthorized use of the account or any security breach they become aware of, by writing to soporte@era-analytics.app.
- Bearing all activities carried out through the account, unless they prove misuse by a third party despite having taken reasonable precautions.
ERa may implement additional verification measures, such as strong authentication, when it considers it necessary to preserve the security of the service.
6. Licence of Use
Subject to compliance with these Terms, ERa grants the User a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Platform in the professional practice of law.
This licence does not in any way include the transfer of intellectual property rights over the Platform, its source code, its interfaces, its procedural calculation engine, its data models, its trademarks, logos, marketing materials or any other component, all of which remain owned by ERa.
6 bis. Mobile Applications and Distribution through Stores
6 bis.1. The Platform is also offered as an application for Android and iOS devices. The application offers the same features as the web version and adds receipt of push notifications and the purchase of subscriptions within the application (§ 4). It does not collect from the phone any data unrelated to the Platform —no contacts, no location, no advertising identifiers—, and everything provided in these Terms and in the Privacy Policy applies to it equally.
6 bis.2. When the User obtains the application through an app store (Apple App Store, Google Play or another), use of the application is also subject to the terms of service of the relevant store. In the event of conflict between those terms and these Terms regarding the licence to use the application, the store's terms shall prevail only to the mandatory extent they so require.
6 bis.3. Conditions required by Apple Inc. With respect to the application distributed through the App Store, the User acknowledges that: (i) these Terms are concluded between the User and Artifizio Technology LLC, and not with Apple Inc.; (ii) Apple is not responsible for the application or its content; (iii) the licence of use is limited to Apple-branded devices that the User owns or controls, in accordance with the App Store Usage Rules; (iv) responsibility for maintenance and support of the application lies exclusively with Artifizio Technology LLC, through the channel indicated in § 28, and Apple has no obligation whatsoever to provide them; (v) any claim relating to the application —including product liability, failure to conform to applicable regulations or infringement of third-party intellectual property rights— shall be addressed to Artifizio Technology LLC and not to Apple; and (vi) Apple and its subsidiaries are third-party beneficiaries of this clause and may enforce it against the User.
6 bis.4. The mobile applications depend on the device's connection and on the notification services of their respective manufacturers. ERa does not guarantee the delivery or timeliness of a push notification, which is an auxiliary channel and does not replace email nor, in any case, the duty to verify time limits that § 9 imposes on the User.
7. User Obligations
When using the Platform, the User undertakes to:
- Comply with applicable Venezuelan legislation, with the ethical rules of the professional practice of law, in particular the Code of Professional Ethics of the Venezuelan Lawyer (Código de Ética Profesional del Abogado Venezolano), and with any other specific regulations of their jurisdiction.
- Use the Platform exclusively for lawful purposes related to professional practice, refraining from using it for fraudulent or dilatory purposes or purposes contrary to the administration of justice.
- Upload to the Platform only data for which they have a sufficient legal basis (professional mandate, consent of the data subject, legitimate interest of the litigation or legal obligation).
- Respect professional secrecy regarding third-party data (clients, opposing parties, witnesses) and properly configure Team permissions to prevent improper access.
- Independently validate all milestones, time limits, dates and results generated by the Platform, by directly consulting the case file, the laws in force and the official computations of the relevant court.
- Keep their own copy of case files, documents and other relevant materials, without relying exclusively on the storage provided by the Platform.
- Not use the Platform's information as the sole source for making irreversible procedural decisions.
- Notify their clients, parties and other interested persons, as appropriate, of the use of ERa as a management tool, and handle any exercise of rights by them regarding the data uploaded.
8. Prohibited Uses
The User is expressly prohibited from, without this list being exhaustive:
- Using the Platform for unlawful or fraudulent activities, activities harmful to the rights of third parties or contrary to public order.
- Uploading content that infringes intellectual property rights, or that is slanderous, defamatory, obscene or discriminatory, or that incites hatred, violence or the commission of crimes.
- Processing data of persons without a sufficient legal basis, in particular sensitive data, data of minors where processing exceeds what is strictly necessary, or data protected by procedural confidentiality.
- Accessing other Users' accounts, attempting to circumvent the Platform's security measures or carrying out penetration tests without ERa's express authorization.
- Reverse engineering, decompiling, disassembling, modifying, copying or distributing the Platform's software, except to the extent strictly permitted by mandatory law. Any infringement will lead to the suspension or termination of the account (§ 19) and to the relevant civil and criminal actions, including those provided for by copyright and computer crime legislation.
- Extracting data by automated means (scraping, crawling) without express authorization, or using the Platform to train third-party artificial intelligence models with data extracted from it.
- Deliberately overloading the infrastructure, carrying out denial-of-service attacks, distributing malware or performing any action that degrades the service for other Users.
- Impersonating third parties, including other Users, lawyers, judges, officials of the judicial system or ERa staff.
- Using the AI Services for purposes other than the professional purposes for which they are designed, in particular to generate binding legal opinions without professional verification.
- Reselling, sublicensing, renting or assigning the Platform to third parties without ERa's express written authorization.
Breach of any of these prohibitions constitutes sufficient cause for immediate suspension of the account and, where applicable, termination of the agreement, without prejudice to any legal actions that may apply.
8 bis. Zero Tolerance for Objectionable Content and Abusive Conduct
ERa does not tolerate objectionable content or abusive users. This clause applies to all content that a User enters on the Platform and that another User may come to see: names of work teams and invitations to collaborate, names and data of cases and clients shared with a team, documents and case files uploaded, service proposals, comments and notes, and summaries sent through the Client Portal.
Objectionable content includes, without this list being exhaustive: offensive, defamatory, obscene or sexually explicit content; content that incites hatred, violence or discrimination on any ground; threats; harassment in any of its forms; impersonation; spam, unsolicited advertising and fraud; and the disclosure of third parties' personal data without a legal basis for doing so. An abusive user is one who enters such content, who uses team invitations or the Client Portal as a means of unwanted contact, or who reoffends after a warning.
The User undertakes not to enter objectionable content and not to engage in abusive conduct. Acceptance of these Terms, required before the account is created, expressly includes this obligation.
Mechanisms available to the User. The Platform makes available to every User, free of charge and without the need for prior justification:
- Report content: on every screen showing content from another User, as well as from My Profile › Security and moderation. The report identifies the content, allows the reason to be stated and a detail to be added, and the User can check the status of the reports they have submitted at any time.
- Block a user: from the invitation received, from the list of team members or from My Profile › Security and moderation. Blocking is immediate and does not require ERa's approval: the blocked user can no longer invite or otherwise reach the person who blocked them, and any pending invitations they had are cancelled. The User may reverse the block whenever they wish.
ERa's commitment. Every report is reviewed within twenty-four (24) hours of its receipt. Once the objectionable content is verified, ERa removes it and, depending on the seriousness and any repetition, warns the responsible User, suspends their account or terminates it permanently, expelling the offender in accordance with § 19. These measures are taken without prejudice to reporting to the competent authorities where the facts may constitute a crime.
Reports may also be sent to soporte@era-analytics.app. ERa keeps the reported content and the record of the measures taken for the time necessary to handle any claims.
9. Informational Nature and Duty of Professional Diligence
The calculations of deadlines, time limits, procedural schedules, milestones, suggested procedural decisions and any information provided by the Platform are exclusively informational and for reference. Under no circumstances should they be interpreted as:
- Binding legal advice.
- Official computation of procedural time limits.
- A substitute for personal review of the court case file.
- A guarantee of accuracy of dates, deadlines or time limits.
- A technical opinion on the facts of the case.
The User acknowledges and accepts that it is their sole responsibility to:
- Verify and validate all deadlines, time limits and dates by directly consulting the case file, the laws in force and the official computations of the competent court.
- Carry out their own legal research and analysis of each case.
- Consult the applicable procedural rules (Code of Civil Procedure, COPP, LOPT, LOPNNA, LAI, LAC, LAV and other special laws) to confirm the information presented.
- Faithfully record the court business days of the courts in which they litigate, verifying the information directly with each court.
- Communicate to their clients, where applicable, the definitive procedural information, without relying exclusively on the Platform's outputs.
9 bis. Corpus of Public Sources and Case Law Search Engine
9 bis.1. Nature of the information. The Platform makes available to the User a structured search engine over information of a public nature, obtained from official and/or freely accessible sources, including the Supreme Tribunal of Justice and the judicial circuits of the Republic, the National Assembly and the Autonomous Service of the National Printing Office and Official Gazette. This is information which, by mandate of Articles 51 and 143 of the Constitution of the Bolivarian Republic of Venezuela and of the rules governing the publicity of acts of the Public Power and of court decisions, is publicly accessible and may be consulted by anyone.
9 bis.2. No ownership of the information. ERa is not the owner, author or proprietor of the court decisions, normative acts, issues of the Official Gazette or any other public-source document that the Platform displays, nor does it claim any right over their content. Those documents remain subject to their own legal regime and their authorship belongs to the bodies that issued or published them. The provisions of § 16 of these Terms refer exclusively to the Platform's own creations —the software, interfaces, indexes, data models, structuring criteria and derived analytical results—, and in no way to the underlying public information.
9 bis.3. Role of the Platform: structuring, not dissemination. ERa's role is limited to technical intermediation: collecting information already published, organizing and indexing it, and displaying it in a structured form to the User who expressly requests it through a query. The Platform does not carry out mass, indiscriminate or proactive dissemination of that information: it does not publish it openly, does not send it to recipients who have not requested it, does not market it as a database and does not make it available to third parties outside the contractual relationship. Each result is shown only in response to an individual, authenticated query by the User, in the same way that the same User could obtain it by directly consulting the primary sources.
9 bis.4. Direct access to the primary sources. The User acknowledges that they may at any time access the information displayed here directly, free of charge and independently of the Platform, through the official portals of the issuing bodies. The Platform neither replaces nor conditions that access, nor does it purport to be an exclusive or preferred channel of consultation.
9 bis.5. Duty to verify at the source. The structuring, analysis, classification, summaries and statistical indicators that the Platform produces on public information are derived works and may contain errors, omissions or outdated information. Before invoking, citing or basing any action on a document obtained through the search engine, the User undertakes to verify its text, its validity and its exact citation in the corresponding official source. This obligation is especially demanding with regard to:
- The validity of rules: the Platform expressly distinguishes between rules whose validity has been established and rules whose validity could not be determined. The latter category does not amount to validity and must not be interpreted as such.
- The citation of court decisions: number, date, chamber, reporting judge and case file must be confirmed against the published original.
- The statistical indicators on the activity of lawyers, judges, justices or parties, which reflect only the subset of decisions incorporated and analysed, and not the whole of those persons' activity.
9 bis.6. Partial coverage. The incorporated corpus is partial and under continuous construction. The absence of a result does not allow the conclusion that the document sought does not exist, has not been issued or is not in force: it may simply not have been incorporated yet. The Platform indicates in its interface the scope of each layer of information.
9 bis.7. Third-party data contained in public documents. Published court decisions contain, by their very nature, the names of parties, legal representatives, judges and justices. Such data are displayed exactly as they appear in the original public document, without enrichment from other sources, without cross-referencing with private data and without profiling for commercial, advertising, credit, employment or similar assessment purposes. The User undertakes to use this information solely for legal research purposes and within the scope of their professional practice, and is personally liable for any use beyond that scope. The processing of these data is governed by the Privacy Policy.
9 bis.8. Legal research tool. The search engine and its analytical features are defined exclusively as a legal research tool. They do not constitute legal advice of any kind, nor a legal opinion, nor an expert report, nor a binding forecast of the outcome of a matter, nor do they replace the lawyer's professional judgement. None of their outputs —including outcome indicators, percentages and answers generated by artificial intelligence— may be invoked as the autonomous basis of a professional action.
9 bis.9. Acceptance of these conditions. Access to the search section requires express acceptance of the conditions contained in this clause, which is requested from the User the first time they enter that section. Acceptance is recorded in the User's account together with its date, is deemed given for subsequent accesses as long as these conditions do not change, and does not exempt the User from compliance with the rest of these Terms. The summary of these conditions remains visible in the section itself, with a link to this full text. Recording the date allows ERa to request a new acceptance if these conditions are amended.
9 bis.10. Removal of content. Any person who considers that the display of a particular document or data item through the Platform harms a legitimate right may request its review by writing to soporte@era-analytics.app, identifying the document and the reason. ERa will handle the request, without prejudice to the document remaining public at its original source, over which ERa has no authority whatsoever.
10. Possibility of Errors
The User acknowledges and accepts that the Platform may contain errors in, among others, the following areas:
- The calculation of procedural deadlines and time limits and the application of the rules on court business days, court holidays and national public holidays.
- The interpretation of the applicable procedural rules and the modelling of the supported proceedings.
- The court business days recorded by the User, their collaborators or as suggested by external sources, which are the responsibility of whoever records them.
- Branching procedural decisions and their effects on the rest of the case schedule.
- Optical character recognition (OCR), segmentation and textual analysis of case files.
- Due dates, reminders and email notifications.
- Any other information, output or suggestion generated by the Platform.
Such errors may arise from legislative changes, procedural reforms, supervening case law criteria, programming errors, outdated data, failures of artificial intelligence providers, unavailability of third-party services or other causes. The Platform is maintained and corrected continuously. Users' detection and reporting of errors is welcome and appreciated.
11. Artificial Intelligence Features
The Platform offers features based on artificial intelligence models provided by third parties, including, among others: optical character recognition on digitized case files, segmentation of case files into procedural acts, structured analysis (summary, facts, arguments, premises), generation of client-oriented summaries and answers to natural-language questions about the Corpus.
Case files are processed with Gemini models hosted on Vertex AI, within a Google Cloud project owned by Artifizio Technology LLC. Under the Vertex AI terms of service, Google does not use the content submitted to train or improve its models. The search engine assistant may run on Google or Anthropic models, depending on the provider ERa has selected at any given time; the Privacy Policy identifies both as data processors.
The User expressly acknowledges and accepts the following with respect to the AI Services:
- Activating these features involves sending the corresponding files and texts to the AI provider, which may entail an international data transfer. The Privacy Policy describes the details of that processing.
- The results generated by artificial intelligence are for guidance only and non-binding. They may contain inaccuracies, errors, hallucinations or biases.
- The User is solely responsible for validating the legal, technical and procedural relevance of any output of the AI Services before using it in their professional practice or communicating it to third parties.
- ERa does not guarantee that the AI models are suitable for every legal situation, that their results are reproducible, or that they are free of errors.
- Use of the AI features is voluntary; the User may refrain from using them and operate the Platform with its core procedural functionality.
- The AI models used may be replaced, improved or withdrawn without prior notice as the provider's offering evolves.
12. Communications to the User: Email and Push Notifications
The Platform sends the User and, if the User so configures it, the User's end clients, email communications relating to: account verification, password recovery, notifications of upcoming or expired deadlines, case summaries for the client and operational notices about the service.
The User:
- Agrees to receive operational and service communications while the account remains active, which cannot be entirely deactivated as they are inherent to the service.
- May configure their preferences for notifications of upcoming deadlines —including the number of days in advance and the activation or deactivation of push notifications— in the Profile module.
- Acknowledges that, on the mobile applications, the Platform records an opaque device identifier, provided by the operating system, for the sole purpose of delivering notifications to it. That identifier is associated with the account signed in on that device, is reassigned if another account signs in and is deleted on sign-out or when the account is deleted.
- Is solely responsible for obtaining their end clients' consent before enabling notifications to be sent to them, and for providing truthful information about the recipient.
- Acknowledges that email delivery depends on external factors (spam filters, domain reputation, availability of the recipient's email provider) and that delivery of push notifications depends on the device manufacturer's notification service and on the device's connectivity. ERa does not guarantee actual receipt through either channel, both of which are auxiliary to the User's duty of verification and do not replace it.
13. Third-Party Services and Activity Logging for Technical Diagnosis
13.1. The Platform integrates with third-party services that act as sub-processors or infrastructure providers, including Supabase Inc., Cloudflare Inc., Google LLC (Vertex AI and Sign in with Google), Anthropic PBC (search engine assistant, when ERa has selected it as provider), Apple Inc. (Sign in with Apple and delivery of push notifications), Stripe, Inc. (charging of subscriptions purchased on the website) and Resend, Inc. The up-to-date list of sub-processors and the data processing terms are set out in the Privacy Policy.
13.2. Use of these services is also governed by the terms and policies of each third party. ERa is not responsible for the actions, omissions, security failures, unavailability or policy changes of those third parties, without prejudice to the reasonable diligence it applies in selecting and monitoring them.
13.3. Technical activity logging and observability. The User expressly acknowledges and consents that, in order to operate the Platform with due diligence, ERa keeps a technical record (logs and invocation traces) of the requests made to the server infrastructure, as well as of the messages the application itself issues for diagnostic purposes. These records are stored and analysed through the technology tools made available by the Platform's Hosting Provider, in particular Cloudflare Workers Observability, with the following characteristics:
- Exclusive purpose: diagnosing errors, monitoring the technical health of the service, optimizing performance, preventing abuse and continuously improving the Platform for the benefit of Users.
- Data minimization principle: a 10% sample is applied to all invocations, and prior automatic filters are applied that redact email addresses, omit complete request bodies and exclude tokens, passwords, OCR content and identifying data of the User's Clients.
- Retention: records are kept on the Hosting Provider's infrastructure for the period provided for in the plan contracted by the Platform (as of the date of these Terms, up to seven (7) days), without ERa storing additional copies outside that environment.
- No commercialization: ERa does not sell, rent, assign or make available to third parties for commercial, advertising or individual profiling purposes the content of these records. Nor does it use them to train its own or third-party artificial intelligence models. Technical access to the observability system is restricted to ERa staff strictly necessary for operating the service and to the Hosting Provider itself as infrastructure operator.
- Legal basis: the processing of these records is based on ERa's legitimate interest in operating, maintaining, securing and continuously improving the Platform, as well as on the performance of this service agreement.
13.4. The User may obtain additional information on the categories of data recorded, the retention periods and the applicable security measures in §§ 5.9, 6, 7, 9 and 12 of the Privacy Policy, and may at any time exercise the rights recognized in the agreement by writing to soporte@era-analytics.app.
14. Collaborative Teams
The Platform allows the User to set up Teams in which they invite other Users as collaborators, granting them granular permissions over milestones, incidents, case files, reviews, clients, court business days and case creation.
The Team director assumes responsibility towards ERa for:
- Inviting only persons with a verifiable professional relationship who are authorized to access the shared data.
- Configuring permissions in line with the duty of professional confidentiality and the principle of least privilege.
- Revoking permissions in good time when the professional relationship ends or when the permissions granted are no longer relevant.
- Informing collaborators of the scope of the Terms and of the Privacy Policy, ensuring that they also accept them.
Each collaborator is fully responsible for the actions carried out with their credentials, including marking milestones, editing court business days and any other operation enabled by their permissions. The Platform keeps traceability of collaborative actions (audit trail), which may be consulted by the Team director.
15. Client Portfolio and Professional Secrecy
The Client Portfolio module allows the User to store corporate and personal data of their clients, associated documents (incorporation documents, RIF tax ID, powers of attorney, identification documents, contracts) and proposals for professional services. The User acknowledges that this information may be protected by the professional secrecy regulated in the Code of Professional Ethics of the Venezuelan Lawyer and by the corresponding procedural confidentiality.
Accordingly:
- The User is the data controller of their clients' data vis-à-vis those clients. ERa acts as data processor on the User's behalf, as detailed in the Privacy Policy.
- The User must have a legal basis to process such data (professional mandate, consent, legitimate interest of the litigation or legal obligation) and to share it with their Team when they so decide.
- ERa applies reasonable technical and organizational measures to preserve the confidentiality of the Portfolio, without prejudice to the residual risk inherent in any computer system.
- Proposals for professional services generated on the Platform are private between the User and their client; ERa does not interfere in the professional relationship or in the setting of fees.
15 bis. Firm Administration (Fees and Expenses)
15 bis.1. The Firm Administration module allows the User to record collections received, reimbursable expenses and operating expenses of their firm, link them to a case or a client, and consult the profitability indicators the Platform derives from those records.
15 bis.2. What this module is not. It is an internal management record, for the User's own information purposes only. It is not an accounting, bookkeeping, tax invoicing or tax advisory service; it does not issue documents with tax validity; and it does not process payments or connect to banks, payment gateways or collection systems. ERa at no time receives, holds or intermediates funds of the User or of their clients.
15 bis.3. Currency equivalents. When the Platform shows the equivalent of an amount in another currency, it does so by applying a reference rate obtained from an external source. That equivalent is merely indicative: it does not constitute a quotation, an exchange offer or a settlement value, may not match the rate applicable to a specific transaction and must not be used to determine tax or contractual obligations.
15 bis.4. The User is solely responsible for the accuracy of what they record, for keeping the corresponding supporting documents and for complying with their accounting, tax and fee-schedule obligations. The setting of professional fees is governed by the Code of Professional Ethics of the Venezuelan Lawyer and the applicable regulations, a matter in which ERa does not intervene.
15 ter. Client Portal
15 ter.1. The Platform offers a Client Portal accessed, with their own client-type account, by the person whom the User expressly invites. Their access is read-only and limited to the information on the cases the User decides to share with them.
15 ter.2. The invitation, the scope of what is shared and its revocation are the exclusive decision of the User, who remains, vis-à-vis their client, the data controller and bound by the duty of professional confidentiality. ERa does not validate the content shared or intervene in the relationship between the User and their client.
15 ter.3. The information the Client User consults in the Portal reflects the record kept by their lawyer and, like every output of the Platform, is informational. It does not constitute legal advice, does not replace communication with the lawyer and does not by itself prove the procedural status of a case, which is recorded in the court file.
15 ter.4. The Client User undertakes not to disclose to third parties the information accessed through this channel, which may be protected by professional secrecy and by the confidentiality of the proceedings.
16. Intellectual Property
The Platform, including its software, source code, interfaces, procedural calculation engine, court database, procedural models, documentation, manuals, marketing materials, trademarks, logos, designs and other elements, is the exclusive property of ERa or its licensors and is protected by Venezuelan and international intellectual and industrial property law.
Nothing in these Terms may be interpreted as an assignment of rights to the User, except for the limited licence of use described in § 6. The User undertakes to respect all intellectual property notices and not to remove, alter or conceal them.
If the User considers that the Platform infringes intellectual property rights, they may give notice through the contact channel indicated in § 28, providing the information necessary to assess the claim.
17. User Content and Portability
User Content is and remains the User's property. ERa claims no ownership rights over the data, files, documents or materials the User uploads to the Platform.
However, the User grants ERa a limited, non-exclusive, worldwide, royalty-free and revocable licence, exclusively for the purposes of operating the Platform, running the AI Services and providing the contracted features. This licence ends when processing of the corresponding data ceases, in accordance with the periods described in the Privacy Policy.
The User may at any time request the portability of their Content in a structured, commonly used format (JSON, CSV, PDF as appropriate), in accordance with the procedure described in the Privacy Policy. The Platform also offers, within its interface, the possibility of exporting PDFs of case files, proposals and summaries for the User's use.
18. Privacy and Data Protection
The processing of personal data carried out by ERa is governed by the Privacy Policy, which forms an integral part of the contractual framework with the User and must be read together with these Terms.
In particular, the User acknowledges that: (i) ERa is the data controller of the User's account data; (ii) the User is the data controller of the data of their clients and of the third parties they upload to the Platform, and ERa acts as processor on the User's behalf; (iii) certain services involve international data transfers subject to contractual safeguards; (iv) data subjects may exercise their rights on the terms described in the Privacy Policy.
19. Suspension and Termination
ERa may suspend, in whole or in part, immediately and without prior notice, a User's or a Team's access to the Platform where any of the following circumstances arises:
- Serious or repeated breach of these Terms or of the Privacy Policy.
- Reasonable indications of fraudulent or unlawful use or use contrary to professional ethics.
- Objective risk to the integrity, security or availability of the Platform or to other Users.
- A request from a competent authority.
- Security incidents requiring immediate containment.
Where the suspension is due to a cause attributable to the User, the User will be informed of the cause and granted a reasonable period to submit their defence before termination, unless the urgency or seriousness of the case makes this inadvisable.
The User may terminate the agreement at any time by deleting their account, as described in § 20.
20. Account Deletion
The User may delete their account at any time from the "My Profile" module. Deletion entails:
- Deletion of the cases, milestones, incidents, digitized case files, Portfolio clients, documents and proposals associated with the account, except those shared with Teams where other Users retain joint responsibility.
- Cancellation of pending invitations and withdrawal from the Teams to which the User belongs.
- Deletion of the file storage associated with the account.
- Immediate cessation of email notifications linked to the account.
Some data may be kept for a limited period due to legal, accounting or evidentiary requirements, in accordance with the periods set out in the Privacy Policy. Before deleting the account, the User is advised to export any content they consider relevant.
21. Changes to the Service
ERa may, at any time and at its reasonable discretion, introduce improvements, modifications, updates or changes to the Platform, as well as add, modify or withdraw features. Modifications introducing substantial changes will be communicated with reasonable advance notice to the User's email address or through a prominent notice on the Platform.
ERa may also discontinue the Platform, in which case it will notify Users with reasonable advance notice and provide the means for them to export their Content before closure.
22. Changes to the Terms
ERa may amend these Terms to reflect legal, technical or operational changes. Amendments will be published on the Platform itself, indicating the date of the new version. Where the changes are substantial, they will also be notified to the User's email address.
Continued use of the Platform after the changes take effect will constitute acceptance of the updated version. If the User does not agree with the new Terms, they may terminate the agreement by deleting their account before the effective date.
23. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Platform is offered "as is" and "as available". ERa makes no express or implied warranties of any kind, including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness, non-infringement of third-party rights, uninterrupted service or absence of errors.
In particular, ERa does not guarantee:
- That the procedural calculations will in every case match the official computations of the courts.
- That the artificial intelligence features will produce results that are accurate, complete or suited to the particular circumstances of the case.
- That the Platform will be available without interruption or free of errors.
- That data transmitted to or from the Platform will always be delivered without delay, alteration or loss attributable to the network.
- That the security measures implemented will be infallible, given the residual risk inherent in any computer system.
The foregoing exclusions are to be interpreted without prejudice to the mandatory obligations that Venezuelan law imposes on ERa as service provider.
24. Limitation of Liability
To the maximum extent permitted by applicable law, ERa, its developers, administrators and other related persons shall not be liable for:
- Missed procedural deadlines, lapses, limitation periods or any procedural consequence arising from the use or interpretation of the information provided by the Platform.
- Professional or legal decisions taken by the User on the basis of the information generated by the Platform.
- Errors in calculations, data, procedural suggestions or artificial intelligence outputs.
- Fines, penalties, reputational damage or consequences arising from the User's professional breaches.
- Indirect damages, loss of profits, loss of opportunity, loss of clientele, moral damages, loss of data not caused by ERa's gross negligence or wilful misconduct, or any consequential or punitive damages, to the extent such items may be excluded by contract.
- Acts or omissions of Users, their Team collaborators or third parties acting on their behalf.
- Unavailability, failures or policy changes of third-party service providers.
- Events of force majeure or acts of God, as described in § 26.
In any event, ERa's aggregate liability to the User, for all items and claims, shall be limited to a maximum of the lesser of: (a) the equivalent of the amounts actually paid by the User to ERa in the twelve (12) months preceding the event giving rise to liability, or (b) the sum of one hundred United States dollars (USD 100.00) or its equivalent in bolívares at the official exchange rate on the date of the event.
The foregoing limitations shall not apply: (i) in cases of duly proven wilful misconduct or gross negligence by ERa; (ii) where Venezuelan law imposes mandatory liability that cannot be contractually waived; or (iii) with regard to damage to life or personal integrity caused by gross negligence.
25. Indemnification
The User undertakes to hold harmless ERa, its developers, administrators, employees, advisers and other related persons from any claim, lawsuit, penalty, fine, cost or expense (including reasonable professional fees) arising from:
- The User's breach of these Terms, of the Privacy Policy or of applicable law.
- Improper, unlawful or fraudulent use of the Platform by the User, their collaborators or third parties acting with their credentials.
- The processing of third parties' personal data without a sufficient legal basis.
- Infringement of intellectual or industrial property rights committed by the User when uploading or using Content on the Platform.
- Breach of professional secrecy or procedural confidentiality by the User or their collaborators.
26. Force Majeure
Neither party shall be liable for the non-performance or defective performance of its obligations where this is due to force majeure or acts of God, understood as events that are unforeseeable, irresistible or beyond the control of the affected party, including, by way of example: natural disasters, pandemics, armed conflicts, acts of authority, general strikes, telecommunications failures, massive cyberattacks, unavailability of critical infrastructure providers and prolonged outages of public services.
The affected party shall notify the other, as soon as reasonably possible, of the cause invoked and the mitigation measures adopted.
27. Assignment
The User may not assign, transfer or sublicense, in whole or in part, their rights or obligations under these Terms without ERa's prior written consent.
ERa may freely assign its contractual position to a successor, subsidiary, controlling or acquiring entity, in the context of ordinary corporate transactions, notifying the User of such assignment with reasonable advance notice where materially possible.
28. Notices
Notices from ERa to the User shall be deemed validly given when sent to the email address registered on the account or through a prominent notice on the Platform itself. The User is responsible for keeping their email address up to date.
Notices from the User to ERa shall be sent to the email address soporte@era-analytics.app, with a subject line identifying the matter (for example, "Support", "Privacy", "Termination").
29. Entire Agreement and Severability
These Terms, together with the Privacy Policy and the legal notices ERa publishes on the Platform, constitute the entire agreement between the parties regarding the use of the Platform and supersede any prior communication, offer, proposal, or oral or written agreement on the subject.
If any provision of these Terms is declared null, illegal, invalid or unenforceable by a competent authority, the remaining provisions shall remain in force to the greatest extent possible. The provision declared null shall be replaced by a valid provision reflecting, as far as possible, the original intention of the parties.
30. Waiver
ERa's failure or delay in enforcing any provision of these Terms shall not constitute a waiver of that right nor limit the possibility of enforcing it in the future. Waivers must be in writing to be valid.
31. Governing Law
These Terms are governed by and construed in accordance with the laws of the Bolivarian Republic of Venezuela, without regard to its conflict-of-laws rules that might lead to the application of another legislation.
Notwithstanding the foregoing, ERa will respect the minimum guarantees that mandatorily correspond to the User under the law of their habitual residence, where their exclusion by contract is not possible.
32. Dispute Resolution
The parties undertake to seek an amicable solution to any dispute arising from the interpretation, performance, compliance or termination of these Terms, through direct negotiation in good faith for a reasonable period of at least thirty (30) days from notification of the dispute.
If the negotiation phase ends without agreement, disputes shall be submitted to the jurisdiction of the competent courts of the Metropolitan Area of Caracas, Bolivarian Republic of Venezuela, without prejudice to any mandatory rules on jurisdiction that may apply to the User by reason of their status or domicile.
The parties may agree, in writing and specifically, to submit a dispute to alternative resolution methods (mediation or arbitration) when they consider it appropriate.
33. Acceptance
By ticking the acceptance box provided on the Platform or by using the Platform on a continued basis, the User declares that they have read these Terms and the Privacy Policy in full, have understood them and accept them in their entirety. The User expressly acknowledges that the Platform is a support tool and that its use does not replace the duty of professional diligence inherent in the practice of law.
34. Language
These Terms are published in Spanish and in English. The English version is a translation provided for the User's convenience; in the event of any discrepancy, conflict or doubt of interpretation between the two, the Spanish version shall prevail. The same applies to the Privacy Policy and to the Cookie Policy.
